CPSC to Sue Makers of Nap Nanny After Infant Deaths

The U.S. Consumer Product Safety Commission (CPSC) announced on Wednesday that it has filed an "administrative complaint" against Baby Matters LLC, regarding its Nap Nanny and Nap Nanny Chill baby recliners. The complaint, which was filed by CPSC staff, alleges that the products "pose a substantial risk of injury and death to infants."

The CPSC's complaint comes after reports that the recliners have been implicated in five infant deaths. The organization noted that it has received at least 70 other reports of babies almost falling out of the recliners.

Here is some of the key information that has emerged regarding the CPSC's complaint against Baby Matters LLC, and the company's Nap Nanny recliners.

* According to the CPSC's complaint, Baby Matters LLC appears to have been aware that there were issues with the Generation One version of the Nap Nanny, as the company issued a recall notice for the product in 2010.

* The heading of the notice states that the company issued that initial recall due to the danger of "entrapment, suffocation, and fall hazards." One infant death had been attributed to that early version of the Nap Nanny recliner, along with 22 incidents of babies nearly falling out of it.

* This new complaint by the CPSC notes that the organization has been notified that four infants have died after being placed in the Nap Nanny Generation Two, and another infant died after being placed in the Nap Nanny Chill recliner.

* The complaint filed by CPSC is requesting that Baby Matters LLC "notify the public of the defect" that can cause injury or death, as well as issue consumers a refund of the purchase price of whichever version of the recliner that they currently own.

* According to a report by NBC News, some 5,000 Nap Nanny Generation One recliners have been sold in the last three years, as well as 50,000 Nap Nanny Generation Two recliners. An additional 100,000 units of the Nap Nanny Chill have been sold to the public.

* The Associated Press noted that Baby Matters LLC reportedly went out of business last month.

* Baby Matters owner and founder Leslie Gudel posted a message on the Nap Nanny website on Wednesday acknowledging that the CPSC had filed a complaint against the company, but asserting that "We do not believe the complaint has merit."

* Gudel further asserted that the incidents in question happened because the Nap Nanny recliner was being improperly used, and that "No infant using the Nap Nanny properly has ever suffered an injury requiring medical attention."
