Thought Samsung was out of the woods when it defeated Apple's attempt to prevent it from selling the Galaxy Tab 10.1 stateside? Well, Apple appealed that decision and was given a second crack at banning Sammy's slate last month -- and it looks like Cupertino made the most of the opportunity, as Reuters reports that Judge Koh has granted Cupertino's request to enjoin the sales of the Galaxy Tab 10.1. Details are scarce at the moment, but we do know it's only a preliminary injunction, meaning if Samsung's ultimately victorious in the case, the injunction will lift and it'll be free to peddle its wares once again. Still, it's certainly bad news for the Korean company, but given its expansive stable of other slates still on sale combined with its recent economic performance, we're sure Samsung can weather the storm while the courtroom fireworks continue.

Update 1: All Things D got a copy of Koh's order, and we just gave it a quick read. Turns out that she granted the injunction due to the strength of the merits of Apple's case and the unlikelihood that Samsung would invalidate Apple's design patent -- the court already held that the 10.1 is "virtually indistinguishable" from the iPad's design and likely infringes Apple's IP. Furthermore, Judge Koh held that, because Apple and Samsung are direct competitors in the tablet space and "design mattered more to customers in making tablet purchases," Apple would be irreparably harmed by further 10.1 sales. Those two factors outweighed any hardship suffered by Samsung, and thus, the Galaxy Tab 10.1 was stricken from US shelves.

Update 2: Well, that didn't take long -- a mere five hours after Judge Koh's order, Samsung filed an appeal, according to Foss Patents.

Gigabyte GA-Z77X-UD3H

Component manufacturer Gigabyte is traditionally terrific at giving motherboard shoppers an easy slate of options: You can find a model for any chipset you?re interested in, at practically any price you can pay. We?ve looked at a number of the newer LGA1155 motherboards recently, which can be used with either Intel?s third-generation (?Ivy Bridge?) or second-generation (?Sandy Bridge?) Core families of processors, and many of them have hugged (or even pushed past) the $300 price barrier. The Gigabyte GA-Z77X-UD3H, on the other hand, comes in at just $159.99 (list) and gives you almost what you can get from some of the pricier contenders.

Utilizing Intel?s Z77 Express chipset, the ATX-form-factor GA-Z77X-UD3H has overclocking capability and fully supports Intel?s Smart Response Technology (SRT), which lets you configure a solid-state drive (SSD) to use for data caching. (For more information about this, read our review of the Intel SSD 311 Series.) To aid with the latter feature, there?s an mSATA port right on the motherboard; just plug in a miniature drive and you?re ready to go. (Gigabyte previously did this on last generation?s GA-Z68XP-UD3-iSSD?it?s a nifty feature.)

The GA-Z77X-UD3H has a number of solid capabilities as well. It can house up to four DIMMs of standard-clocked dual-channel DDR3 1600 memory; it also supports overclocked rates up to DDR3 2666, though higher-end (and higher-priced) motherboards like the Editors? Choice Asus P8Z77-V Deluxe and the ECS Z77H2-AX can crank it up to DDR3 2800. Expansion slots are a fairly typical affair. In addition to one standard PCI and three PCI Express (PCIe) x1 slots, there are three PCIe x16 slots: one running at x16, one running at x8, and one running at x4?though if you want to use the last one, you won?t be able to use any of the x1 slots because all four share bandwidth. The GA-Z77X-UD3H does conform to the PCIe version 3.0 standard. You?re limited to a maximum of two video cards, though?you can put three or more in the Asus and ECS boards. And if you do use discrete video, LucidLogix?s Virtu MVP virtualization provides dynamic switching between it and the Intel integrated system.

You have plenty of other installation options on the GA-Z77X-UD3H. In addition to the aforementioned mSATA connector, there are two 6Gbps SATA III ports and four 3Gbps SATA II ports (all of which support RAID Levels 0, 1, 5, and 10) that are driven by the Intel storage controller. A secondary Marvell 88SE9172 chip handles the two 6Gbps eSATA ports on the rear panel.

Speaking of which, back there you?ll find those eSATA ports joined by a decent combination of current and legacy jacks. There?s a single PS/2 port for connecting an old-style keyboard or mouse, six USB 3.0 ports, four display outputs (VGA, DVI, HDMI, and DisplayPort), Gigabit Ethernet, S/PDIF optical out, and six analog audio ports for connecting an eight-channel surround-sound system. Motherboard headers let you add up to six additional USB 2.0 ports as well.

The GA-Z77X-UD3H boasts a number of Gigabyte-specific features as well. It meets the company?s ?Ultra Durable 4? standards for construction, which means additional copper in the PCB, glass fabric material that protects against humidity, electrostatic protection, built-in power surge protection and DualBIOS function that automatically restores from a backup BIOS file in case of a power outage, and all solid caps for reducing operating temperatures. The motherboard uses an entirely digital PWM controller for enhanced precision in power delivery, and an associated utility gives you control over system voltages, phases, and frequencies. EZ Setup simplifies the process of configuring your system to use Intel?s key Ivy Bridge technologies (Smart Response, Rapid Start, and Smart Connect). A couple of technologies aid in the charging of devices: All USB ports on the system pass three times more power than usual, which will help you charge devices faster, and On/Off Charge lets you charge your iOS device even if your computer is asleep.

We also want to call out something else about the GA-Z77X-UD3H. Gigabyte stuck with a hybrid version (UEFI functionality, BIOS look and feel) for a long time?a little longer than it should have, in our book?but now it?s graduated to one of the easiest-to-use and nicest-looking UEFIs out there. The appropriately named 3D Mode lets you click on the various components on a picture of the motherboard and receive the options that apply to that part of the hardware; it?s a great tool for beginners, though Advanced Mode offers the full slate of deeper-dive options for the users who?ll appreciate those. When Gigabyte jumps into the future, it does so with both feet.

Performance tends not to vary a great deal between same-class motherboards; we?ve found that in our recent testing of first-wave Ivy Bridge boards, but even so the GA-Z77X-UD3H routinely finishes near the middle of the pack. It nabbed top honors on only one of our tests (Handbrake 0.9.6 video transcoding, which it finished in 30 seconds?one second less than the Asus P8Z77-V Deluxe required), but it was solid across the board.

When we measured full-system power usage using an Extech Datalogger, the Gigabyte motherboard used the least electricity after 15 minutes of idling (71.1 watts), but the second most under full load (139.1 watts, although well behind the ECS Z77H2-AX?s monstrous 158.5 watts). By comparison, the Intel Desktop Board DZ77GA-70K used 71.2 watts when idle and proved the least power hungry under full load, drawing only 136.3 watts.

The more you crave exotic or powerful extras for your Z77 Express motherboard, the less appropriate the Gigabyte GA-Z77X-UD3H will be for you. Its entry-level pricing has meant some corner cutting, and a lack of functionality that more die-hard users would no doubt appreciate (such as, among other things, Wi-Fi and Bluetooth support). You can get those features on more extreme motherboards like the Asus and ECS models?but you?ll also pay as much as twice the GA-Z77X-UD3H?s price. If you don?t need all that additional bling, however, the GA-Z77X-UD3H is a nice little board at a nice little price.

High court rejects part of Arizona immigration law

WASHINGTON (AP) ? The Supreme Court threw out key provisions of Arizona's crackdown on illegal immigrants Monday but said a much-debated portion could go forward on checking the status of suspects who might appear to be in the U.S. illegally.

The court upheld the "show me your papers" requirement that police check suspects' immigration status. Even there, though, the justices said the provision could be subject to additional legal challenges, and they removed some teeth by prohibiting officers from arresting people on immigration charges.

The Obama administration had assailed the Arizona law as an unconstitutional intrusion into an area under Washington's control, and the court struck down provisions that would have made state crimes out of federal immigration violations.

But several lawmakers and civil rights groups said the part of the law left in place by the high court was an invitation to racial profiling.

The court announced that Thursday would be the last day of rulings this term, which means the decision on President Barack Obama's landmark health care overhaul probably will come that day.

The Arizona decision landed in the middle of a presidential campaign in which Obama has been heavily courting Latino voters and Republican challenger Mitt Romney has been struggling to win Latino support. During a drawn-out primary campaign, Romney and the other GOP candidates mostly embraced a hard line on illegal immigrants, though Romney has lately taken a softer tone.

Romney did not immediately comment on the court decision Monday, but he said, "I believe that each state has the duty ? and the right ? to secure our borders and preserve the rule of law, particularly when the federal government has failed to meet its responsibilities."

In Monday's decision, the court was unanimous on allowing the immigration status check to go forward. The justices were divided on striking down the other portions.

Justice Anthony Kennedy said the law could ? and suggested it should ? be read to avoid concerns that status checks could lead to prolonged detention.

The court struck down these three major provisions: requiring all immigrants to obtain or carry immigration registration papers, making it a state criminal offense for an illegal immigrant to seek work or hold a job and allowing police to arrest suspected illegal immigrants without warrants.

Arizona Gov. Jan Brewer said the ruling marked a victory for people who believe in the responsibility of states to defend their residents. The case, she said, "has always been about our support for the rule of law. That means every law, including those against both illegal immigration and racial profiling. Law enforcement will be held accountable should this statute be misused in a fashion that violates an individual's civil rights."

Civil rights groups that separately challenged the law over concerns that it would lead to rights abuses said their lawsuit would go on.

Even with the limitations the high court put on Arizona, the immigration status check still is "an invitation to racial profiling," said American Civil Liberties Union lawyer Omar Jadwat.

The Obama administration sued to block the Arizona law soon after its enactment two years ago. Federal courts had refused to let the four key provisions take effect.

Five states ? Alabama, Georgia, Indiana, South Carolina and Utah ? have adopted variations on Arizona's law. Parts of those laws also are on hold pending the outcome of the Supreme Court case.

Chief Justice John Roberts and Justices Stephen Breyer, Ruth Bader Ginsburg and Sonia Sotomayor joined all of Kennedy's opinion.

Justices Antonin Scalia and Clarence Thomas would have allowed all the challenged provisions to take effect. Justice Samuel Alito would have allowed police to arrest undocumented immigrants who seek work, and also make arrests without warrants.

Scalia, in comments from the bench, caustically described Obama's recently announced plans to ease deportation rules for some children of illegal immigrants.

"The president said at a news conference that the new program is 'the right thing to do' in light of Congress' failure to pass the administration's proposed revision of the Immigration Act. Perhaps it is, though Arizona may not think so. But to say, as the court does, that Arizona contradicts federal law by enforcing applications of the Immigration Act that the president declines to enforce boggles the mind," Scalia said.

The Arizona case focused on whether states can adopt their own measures to deal with an estimated 11 million illegal immigrants in the face of federal inaction on comprehensive reform, or whether the federal government has almost exclusive authority in that area.

Kennedy wrote obliquely about the impasse at the national level.

"Arizona may have understandable frustrations with the problems caused by illegal immigration while that process continues, but the state may not pursue policies that undermine federal law," Kennedy said.

Justice Elena Kagan sat out the case because of her work in the Obama administration.

16-Ounce Cokes and 40 Joints a Month: When Government Dictates to Consumers

Jos? Mujica is the Uruguayan Bloomberg.

Like the mayor of New York, the president of Uruguay is a social engineer, convinced to the core that he knows best when getting citizens to do the right thing.

Bloomberg and Mujica even have a mutual fan club going. Bloomberg donated $500,000 and called the Uruguayan leader nearly two years ago to urge him on in support of the country?s ?labeling law that requires 80 percent of the front and back of cigarette packages to be covered with health warnings, an action that provoked the ire of Philip Morris International.

Recently both Bloomberg and Mujica have upped their game: Bloomberg gave Coca-Cola? and other soft-drink companies spasms when he proposed a 16-ounce size limit on the sugary beverages in restaurants, movie theaters and the like. (Best random quote on Bloombergian food policing: ?He?s of the generation of Jewish men who feel that if they didn?t become a doctor they are a failure. Now he?s trying to become a doctor.??Fran Lebowitz in The New Yorker.)

Mujica has arguably done his friend Mike one better. He proposed earlier this week to legalize marijuana to stopper drug-related violence in his little country whose population is less than half that of New York City. Making pot more readily available would, in theory, quell demand for harder stuff like cocaine base, an intermediate in the production of the drug.

Legalize pot? So what? Isn?t everyone doing that or at least doing it and slapping on a bureaucratic moniker like decriminalization?

Details matter. Mujica?s initial proposal essentially sets out what might be called weed socialism. The plan foresees the national government becoming the source of hemp supply for all Uruguayan users.

Any interested adult would go to a consumer pot registry and, once enlisted, be entitled every month to buy up to 40 joints, or porros, as they?re called in Spanish (much better than the Anglo-Saxonism or even ?reefer?).

Okay, let me anticipate a multitude of reader comments here: What?s any of this have to do with science? First, Bloomberg: the New York mayor is big on his data-driven approach to getting citizens to behave properly. The Atlantic just ran a critique by researchers involved in the studies cited by the Bloomberg administration to justify the cap on drink size, economists who predicted that his plan may backfire. In the lab, people will over-consume when freely offered super-size portions. Having to choose among a range of sizes on their own in the real world is a different story.? There, they tend to pick what they are used to drinking, whether a large or small beverage.? Limiting consumption in that situation, the economists contend, may only prompt over-imbibing later: I was good this morning so I can splurge this afternoon.

So much for Northern Hemisphere science. There?s a long tradition of New York mayors imploding as their time in office nears a close. Now back to the southern cone. Mujica?s plan might be similarly science-challenged. Like his buddy Mike, he might be running into his own ?size matters? problem.

The minutiae of goods-rationing systems (operations research is science, right?) were a strength (maybe the wrong word) of the former Soviet bloc, but five-year plans for bread and dishwashers are a bit different than dealing recreational drugs at the state store.

The Mujica plan tentatively foresees making available for purchase no more than 40 porros a month. Researching the optimal-allotment size question is not grist for a typical PubMed search. Little more than a joint a day for regular users, though, might be viewed as a form of deprivation, which could lead to the same kind of compensatory over-indulgence engaged in by soda drinkers who expect their daily due. The extra supply would have to come from the illicit market.

For the government, the logistics might prove a touch daunting even for a country with a small population. Some reports have the national government planning to track the porros with chemical signatures and requiring users to return the roaches to the state store, presumably to ensure that the cigarettes weren?t resold after purchase. All this in the end may get worked out: as president, Mujica has often projected more the pragmatism of Brazil?s Lula than the dogmatism and hyperbole of Venezuela?s Chavez.

Anyway, one expects quirky ingenuity from newly developing countries. Uruguay is only a few hundred miles from the Bolivian border, a place where President Evo Morales has promoted the message that la hoja de la coca no es droga. And Bolivia is right next to Chile, which, at the other end of the political spectrum, once served as a social laboratory for Milton Friedman?s free-market ideas during the Pinochet years.

Nationalizing pot sales is just what you would expect from a 77-year-old former leader of the Tupamaro urban guerilla movement?and it marks a challenge to the long-time U.S. regional policy of viewing drug control as a relentless battle against suppliers. This time, though, Mujica shouldn?t count on another call and charitable offering from ?compa?ero Mike. Maybe, rather, a congratulatory tweet arriving from the outer reaches of the great beyond and signed by Abbie Hoffman.

Breast Cancer: Missed Interval and Screening-detected Cancer at Full-Field Digital Mammography and Screen-Film Mammography-- Results from a Retrospective Review.

Abstract

Purpose:To compare the percentages and mammographic features of cancers missed at full-field digital mammography (FFDM) and screen-film mammography (SFM) in women who participated in the Norwegian Breast Cancer Screening Program in 2002-2008.Materials and Methods:Social Science Data Services approval was obtained; the requirement for informed consent was waived. Cases were all the interval and screening-detected cancers from 35 127 FFDM and 52 444 SFM examinations in two Norwegian counties. Prior and diagnostic FFDM examinations of 49 interval and 86 screening-detected breast cancers were reviewed by four breast radiologists and compared with a review of SFM examinations of 81 interval and 123 screening-detected cancers. Cancers were classified as missed or true, mammographic features were described, percentages were compared by using the ?(2) or Fisher exact test, and 95% confidence intervals (CIs) were calculated.Results:The percentages of interval and screening-detected cancers missed at FFDM and SFM did not differ significantly. (interval cancers missed: 33% [16 of 49] at FFDM vs 30% [24 of 81] at SFM [P = .868]; screening-detected cancers missed: 20% [17 of 86] at FFDM vs 21% [26 of 123] at SFM [P = .946]). Asymmetry was present in 27% (95% CI: 13.3%, 45.5%) of prior mammograms of cancers missed at FFDM and 10% (95% CI: 3.3%, 21.8%) of those missed at SFM (P = .070). Calcifications were observed in 18% (95% CI: 7.0%, 35.5%) of the cancers missed at FFDM and 34% (95% CI: 21.2%, 48.8%) of those missed at SFM (P = .185). Average mammographic tumor size of missed cancers manifesting as masses was 10.4 mm at FFDM and 13.6 mm at SFM (P = .036).Conclusion:The use of FFDM has not reduced the challenge of missed cancers. Cancers missed at FFDM tend to have different mammographic features than those missed at SFM.? RSNA, 2012.

Robert Randolph Accuses John Travolta of Gay Trysts, Sues Actor For Damaging Reputation

John Travolta is being sued by author Robert Randolph, who accuses the movie legend of numerous gay trysts and consequently claims that Travolta spread lies about Randolph's mental health in order to diminish his credibility.

Robert claims he personally saw John engage in gay sex at various bathhouses.

The book, entitled You'll Never Spa in This Town Again, details Travolta's alleged sexual exploits with other men, including Randolph himself.

In his suit, Randolph claims that as he was releasing his book, Travolta and his powerful attorney Marty Singer unleashed a P.R. attack against him.

They claimed, Randolph says, that he had mental issues and had been institutionalized, all as a calculated attack to paint him as an unreliable source.

Randolph claims the plan worked and that retailers were deterred from selling his book. He is suing both Travolta and Singer for unspecified damages.

Another alleged Travolta gay lover, Doug Gotterba, is also said to be writing a book. Re: Randolph, a rep for Travolta has issued a statement saying:

"The lawsuit filed by Robert Randolph is absurd. The suit is based on a privileged communication, and it will promptly be thrown out by the court."

The statement continues, "To evaluate the credibility of Robert Randolph and his ridiculous lawsuit one need look no further than his own statements on his website stating that he sustained 'permanent brain damage' and had to 'retrain' his brain."

"Mr. Travolta will aggressively defend himself against this lawsuit and expects to be fully vindicated when this meritless case is dismissed."

Singer also said in a statement: "This is a ridiculous lawsuit. It is based on a letter which is completely privileged under the law. We intend to sue the attorneys for malicious prosecution after the court promptly dismisses this baseless lawsuit.”

Maybe so, but this is like the 500th story in which someone claims John Travolta is gay. We don't care either way if he is, but it's interesting.
